Protecting Your Intellectual Property

Jun 5, 2008
A whole bunch of things is invented everyday. People use other ideas to create a structure for their inventions or try to make something completely new. Inventions are the product of our mind, and we should be able to obtain benefits when creating something that is useful and new. But, like in all fields, some people will try and commit frauds by taking what is right for others, in other words, stealing one's intellectual property.

Some people suffered because their inventions were stolen and couldn't obtain any profit, so this is why acquiring protection is very important. There are laws that will help you protect the things you invented from plagiarism and make everything more profitable for you. The design and the innovation will be protected by these laws, so the main thing is to know how it works and how you obtain that security.

The answer to this question is the United States Patent and Trademark Office. The USPTO is a branch of the US government that is responsible for protecting the intellectual property of people. To do this, the person with a certain design or an invention should have it patented in the PTO. However, the process is complicated and will require a certain amount of time. You have to consider that the laws concerning the intellectual property is a special kind of law that requires a special kind of lawyer.

You will receive great help during the process from a specialized lawyer. Also, they will make sure that you completely understand the process and you are ready to participate. The lawyer should assist you during each step, making sue that everything is right. But the thing you need to do, in order to start the process, is show the blueprint and a prototype of your innovation to your lawyer, to show that you are the inventor.

The lawyer will then prepare all the legal documents and all the paperwork you have to sign to get your invention patented. By fulfilling all the requirements of the US Patent and Trademark Office, your invention will be examined by the personnel in the USPTO. They will conduct several examinations to your inventions and determine if it is qualified for patenting. They will also search if your idea has already been invented, which is a ground for disqualification.

Demonstrating the usefulness and the way your invention works is another part of the process, the USPTO will also make some scientific tests to see if the invention fits their categories and requirements. After this, the administered patent exam is taken. This exam makes sure that your invention meets all the regulations in the USPTO and it is called the United States Patent and Registration Office exam.

If you are knowledgeable about the step-by-step process in the USPTO, you can file the patent for yourself without the assistance of a lawyer. This particular procedure is called filing a patent pro se. You will not need to be represented by a registered patent attorney or a patent agent. However, it is not recommended for people who don't know anything about the USPTO process because you have to consider that it is a complicated and hard process to go through.

Being mentally prepared is not enough because registering also means that you will spend a lot of money. Especially on the lawyer fees, which will cost you over US$20, 000. So you have to think good before making this step, otherwise you could lose a lot of money and time. Also, knowing about the system of patenting will help you a lot so make sure you understand everything that is involved in the process.

These are some of the things you need to consider when patenting an invention. If you are sure that it is worth patenting your invention, then you should visit a patent lawyer and they will be able to provide you with all the necessary information regarding the patent filing process.

Make sure before you start this process that the invention will be something very new and will bring you more money than you invested, otherwise there is no reason to waste that time and money in order to patent it.
