Just Versus Petty Suits in Pennsylvania

Accidents happen all the time, but some of them have bleaker consequences than others. For example, the effects of a scraped knee are much milder than the consequences of a broken neck or a pre-mature death.

In addition to the emotional strain that a serious injury or wrongful death can impose on a family, the event can also have far reaching-financial consequences. That is why some residents in the state turn to a Pennsylvania wrongful death lawyer.

If you truly feel that you are suffering the consequences of a wrongful death, it would definitely be wise to hire a lawyer. In addition to knowing the legal system inside and out, a lawyer will be able to identify the strongest points in your case, present them to the court in a convincing manner, and hold more credibility than an emotional or angry relative of the deceased. In many cases, a lawyer's services can make or break the case and win or lose the settlement that your family needs.

On the other hand, if you really are just an angry or grieving family member looking for someone to blame, some financial gain, or a little bit of revenge, your case doesn't belong in the court room because petty suits have significant negative effects on society. For example, a sue-happy society raises the cost of insurance, wastes money and time, over-burdens the judicial system, and drives ethical and talented people away from skilled professions.

The medical profession is just one of many areas where law suits are having all of these effects. Malpractice insurance can cost hundreds of thousands of dollars annually. If medical service prices don't rise along with the insurance costs, we could run doctors right out of business.

If they don't go bankrupt first, the increasing risks of being taken to court and being sued for everything they're worth might make them shy away from the profession altogether; especially since it costs so much time and money to become a doctor in the first place.

Whether you are dealing with doctors, neighbors, or business men, suing is an expensive process. For example, one hour of an expert witness's time can cost more than $1,000, not to mention the time that your lawyer will put into the case.

If we wanted to cut down on frivolous suits, it might be wise to make a few consequences like the losing prosecutor having to pay for the legal fees that the winners incurred. A consequence like that would definitely make people a little less eager to sue unless the case was truly justified. There are plenty of lawyers who will defend any case that comes their way, but that doesn't make it a good idea. Be wary of going into court.
