Finally, The California Lemon Law Is In Effect And Can Keep Up With Other Laws That Protect Consumer
There are so many laws in California that you sometimes wonder if there is anything you can do at all without breaking one of them. Even though that is true, it's really good that the consumer can feel protected and aided in making sure that they do not get taken when they purchase a product.
California has a great love for puppies and many years ago passed the California Puppy Law. This law applies to not only puppies, but to dogs and other pets as well even if they aren't a dog. This law came into play when pet stores would sell dogs that were sick of have some serious health issue and they wouldn't tell the buyer of the pet. If this was proven by the consumer, then the pet owner would have to replace the pet or refund the money. This law is great, but vehicle consumers wondered what would happen if they were lied to about a car. Again, this now has been taken care of.
Then the California Appliance Lemon Law was passed. This law is applicable when the appliance that was purchased doesn't work and after a reasonable amount of attempts by the manufacturer to fix it, doesn't work. This law guarantees the consumer their money back or an appliance of equal or greater replacement. This is another one of those laws that are wonderful to have, but still there was nothing done for the vehicle consumer.
Then along came the Song-Beverly Consumer Warranty Act which is better known as the California Lemon Law. This law applies to vehicles that are new, used and/or leased that have been found to have a malfunction that is unable to be repaired after a reasonable amount of times that the dealership tried to do so.
The consumer, if they believe they have a lemon, should contact the dealership and manufacturer and then contact an attorney that specializes in this law. If your vehicle qualifies, then you will be entitled to either a refund or a new replacement vehicle of the same make and model.
Having laws like the above are very necessary when you make a purchase and the seller is less than honest. In the case of the vehicle lemon law, you are probably spending thousands of dollars on an investment that takes a large amount of your heard earned money every month. Get a good attorney that will give you a free case evaluation and go after the gigantic vehicle manufacturers and make them reciprocate you for your lemon.
