Child Custody Rights of Fathers

Contrary to popular belief, it is possible for a father to win custody of his child. Fathers have custody rights that are the same as the mothers. Even if the mother is equally qualified to retain custody of the child, a father can still win the right to be the custodial parent. However, you need to be prepared and know what to take with you to court in order to come out the winner.

Don't expect your lawyer to take care of all the details for you. You are the one who knows what the case is all about. If there is information your lawyer needs to present in court, make sure he is aware of all of the details of your case.

Try to come to an agreement with your former spouse in advance. If you can work out an arrangement ahead of time, or at least show the court you tried, you will present better in court.

Keep your cool. Once you get into court, you may find that the other side is presenting you in a very poor light. Your side will get a chance to present evidence as well. You will need to be prepared for anything when you step into the court room, and maintain your composure.

Learn the criteria for your state determining custody. Look for examples of rulings that will apply to your case.

Know the other parent's weaknesses. No one else knows the other person better than you do and you know the areas where they have failed. Document anything that will show the other person's weakness in parenting.

Be on your best behavior during the separation leading up to the custody hearing. Always pick up and drop off the children on time, and stick to any temporary custody arrangement that has been made. Keep documentation of every hour you spend with them and any time their mother has failed to pick them up. Many judges will lean towards documentation kept by one parent if that is the only record of what has taken place. You need to show that being with your child is your first priority.

Be prepared with character witnesses to testify on your behalf. Other adults who are important to your child can testify to your parenting skills and abilities, and the level of involvement you have in your child's life.

Preparation is the key to getting custody and upholding your child custody rights. Do your research and don't be afraid to ask for referrals or help from other dads who have been successful in getting custody of their kids. When you select your lawyer, ask about your case, and about father's rights. Make sure you choose an attorney who is supportive of your desire to win custody, and can come up with a plan best suited to your situation.
