How A Criminal Defense Attorney Represents Defendants
When accused of a crime, a consumer needs to see a criminal defense attorney. These types of attorneys are able to defend their clients against all sorts of accusations- from government to personal disputes. A criminal defense lawyer takes time in finding, as they are all different and have certain area of specialties.
Often times, the criminal defense lawyer will be protecting their client from a charge issued by the government. A clear example of this would be with a DUI case, or a driving while under the influence matter. If caught driving in a questionable state of mind, a police officer could arrest you, and the state would then prosecute you. The criminal defense lawyer would be a key player in proving your innocence.
In some cases, the criminal defense lawyer may focus on proving that his or her client is protected by laws that one may be unaware of. An example could be with the Miranda rule, which states that most arrests will demand that you have been read your rights for it to be considered a legal arrest. Otherwise you could have the opportunity to overturn the accuser.
Lawyers shouldn't care whether or not a client is actually guilty of a crime- it isn't their job to judge them. Instead, a criminal defense attorney focuses on the facts and finds a way to prove innocence through logical reasoning. It is not required to tell an attorney whether or not you are guilty, but you may do so if you feel it is relevant.
Other times you may know you are guilty, and you don't want to waste the time of the courts. In that situation, you can simply go to a lawyer and ask him or her to make a bargain. In a bargain, you will admit that you are guilty and the attorney will get the best possible deal that he or she can. This might be a lesser prison sentence, a lesser fine, or easier terms of community service and so on. It's well worth the effort to get a reduced sentence.
The justice system doesn't always work. In a case of having a trial by jury, you could easily be proven guilty where you are innocent due to an error in judgment by the jury. Other times a judge may not be so understanding of your case. To prevent both things from happening, you should always get an attorney to argue your case. An attorney makes you appear more determined and focused to solve the dispute.
In Conclusion
The average lawyer is going to be very experienced in helping your case. Just because they have a high price doesn't mean you should represent yourself. Instead, realize that there are very real penalties of losing a court case and find a good attorney near you.
